These Terms of Service ("Terms") govern your use of the AbbyAI mobile application ("App") provided by OctiCorp ("we", "us", "our"). By downloading or using the App, you agree to these Terms.

1. Service Description

AbbyAI is an AI-powered health coaching application that provides personalized meal suggestions, exercise guidance, calorie tracking, and wellness coaching. The App is intended for general wellness purposes only.

2. Medical Disclaimer

AbbyAI is not a medical device and does not provide medical advice. The information provided by the App, including AI coaching responses, meal plans, and exercise suggestions, is for informational and educational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.

Always consult your physician or qualified health provider before starting any diet, exercise program, or making changes to your health routine. If you have a medical condition or take medication, seek medical advice before using this App.

3. Subscriptions & Billing

• Free Tier: 3 AI actions per day, shared across AI chat, meal suggestions, and food photo analysis.
• Pro Monthly: $4.99/month. 10 AI actions per day, shared across AI chat, meal suggestions, and food photo analysis. All non-AI features (logging, tracking, charts) remain unlimited.
• Pro Yearly: $49.99/year ($4.17/month equivalent). Same 10 AI actions per day as Pro Monthly.
• AI Credit Pack: $0.99 one-time purchase that adds 50 AI credits to your bank. Banked credits roll over across days and are consumed only after your daily allowance is exhausted. Available to both Free and Pro users; stackable across multiple purchases. Credits are non-refundable, non-transferable, and have no cash value.

Subscriptions are billed through your Apple ID account. Payment is charged at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

You can manage and cancel subscriptions in your Apple ID account settings. No refunds are provided for partial billing periods.

4. User Responsibilities

• You must be at least 13 years old to use the App
• You are responsible for the accuracy of information you provide during onboarding
• You agree not to misuse the AI coaching feature (e.g., attempting to extract harmful advice)
• You acknowledge that AI suggestions are generated automatically and may not always be perfectly accurate

5. Intellectual Property

The App, including its design, code, AI models, and content, is owned by OctiCorp and protected by intellectual property laws. You receive a limited, non-transferable license to use the App for personal, non-commercial purposes.

6. Data & Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of data as described therein.

7. Limitation of Liability

To the maximum extent permitted by law, OctiCorp shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, health outcomes, or profits, arising from your use of the App.

The App is provided "as is" without warranties of any kind. We do not guarantee that AI suggestions will be error-free or suitable for your specific health situation.

8. Modifications

We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms. Material changes will be communicated through the App or via email.

9. Termination

We may terminate or suspend your access to the App at any time for violation of these Terms. You may delete your account and data at any time using the "Reset App" feature in Settings.

10. Governing Law

These Terms shall be governed by the laws of the United States. Any disputes shall be resolved in the courts of the state in which OctiCorp is incorporated.
